BYLAW NO. 3-2024
A BYLAW OF THE VILLAGE OF NEVILLE TO PROVIDE FOR THE REMOVAL OF SNOW AND ICE
The Village of Neville strives to clear roads as quickly as possible after significant snowfalls or winds which cause snowdrifts to accumulate. The primary goal is to maintain Village streets and sidewalks such that they remain safely passable. This does not mean that every hazard can be eliminated; vehicles must be properly equipped for winter driving and drivers must use good winter driving practices, pedestrians must ensure they are prepared with proper winter footwear. The Village tractor does not have a cab and roads will not be cleared in extreme cold conditions.
The Council of the Village of Neville, in the Province of Saskatchewan, enacts as follows:
1. That every occupant, and in case there is no occupant, then the owner of every property fronting or abutting on a street where the sidewalks are in the Village of Neville, shall, within the first forty eight hours after every snowfall or hail, or after a fall of snow from off a building, cause the same to be removed entirely off the sidewalk fronting or abutting said property.

2. That no person shall cause any injury to any sidewalk or pavement in the Village by striking, picking or cutting the sidewalk with any shovel, pick, crowbar, or any other metal instrument when the person is engaged in removing snow or ice from the pavement. Similarly, no person shall cause injury to any sidewalk or pavement in the Village with power equipment when the person is engaged in removing snow or ice from the pavement.

3. Snow and ice removed from residential and commercial property shall remain on the property of the owner. No property owner shall dispose of snow or ice by moving it from their property or sidewalk onto private or municipal property without prior permission of the property owner or municipality.

4. That when the sidewalks are not cleared within 48 hours, as mentioned in section 1 of this Bylaw, it shall be lawful for the Council of the Village of Neville to have the work done. All expenses incurred by the Village when clearing snow and ice shall be charged to the owner of the property fronting or abutting the sidewalks. In the case of nonpayment of the expenses incurred, the Village has the authority to add the unpaid portion to the tax roll.
5. While clearing snow, Village employees will do their best to keep driveway accesses clear, however, in some cases this may not be possible. In these situation, it is the responsibility of property owner to clear their driveway access.

6. Back alleys will not be kept clear of snow by the Village. Back alleys are not to be used to pile snow from public or private property.

7. When the amount of snow removal required exceeds the capability of the Village, a Council approved contractor shall be contacted to assist with clearing Village right of ways.

8. Bylaw Number 1-2019 is hereby repealed.

9. This bylaw comes into force and effect on the date of the final passing thereof.
